Applying for a Georgia Real Estate License with a Felony, Dui, or misdemeanor
"The Real Estate Commission STRONGLY RECOMMENDS that applicants having prior criminal convictions and/or disciplinary
actions submit an
Application for Background Clearance prior to scheduling and paying for the examination. The
background clearance decision will allow the applicant to determine if they would be approved for licensure/classification
prior to incurring the expense of educational classes and/or examination fees. There is no
fee for this application."
Are you worried about your criminal background check not coming out clean when you are applying for your
Georgia real estate license?
Even if it comes back not clean, do not loose hope. There is still a good
chance that having a felony will not prevent you from getting your Georgia real estate license.
We have
written a bunch of letters of reccomendation to
the Georgia real estate commission over the years. Generally
speaking, if it is not a felony involving fraud, viloence, or misappropriation of monies, we have seen
the person be granted their Georgia real estate license. Another thing that it seems the real estate
commission is looking for when making a preliminary decision on granting a license is the date of the occurance.
The older the felony or crime, the better chances of a decision in your favor being made.
The information that is
needed to take if you know that you have a felony on your criminal history are as follows:

(1) the citation, accusation, information, or indictment that led to the conviction, and
(2) a certified copy of the sentence / final disposition of every conviction
(3) an explanation of the circumstances surrounding every conviction
(4) three letters of recommendation from individuals not related to you by birth or marriage
This information will need to be sent in with your application for real estate licensure. Allow some extra time
for your license to be processed due to the investigation period. The general time frame the Georgia Real Estate
Commission says that this

Continued.... investigation takes is normally one month but sometimes as much as four months. Once
The Commission completes the investigation, it is brought in front of the board for a vote. If the vote is in your
favor to get a Georgia Real Estate License, you will be notified by mail or phone. You will then be issued a Clearance
Letter, which must be taken to the state testing center so that you can get your license.
